Who is a “foreign person”? 

In short, anyone who is not a “U.S. Person.”

U.S. Person:

  • U.S. citizens (including companies and other organizations incorporated to do business in the U.S.);
  • Lawful permanent residents (green card holders); and
  • Protected individuals under federal regulations (e.g., persons who have received asylum).

Foreign Person:

Everyone else, including foreign businesses not incorporated in the U.S. and persons representing Foreign Persons.  Includes:  H-1B work visa, F-1 study visa, J-1 training visa.
